The schedule under 63(4)(c) of The Bharatiya Sakshya Adhiniyam 2023 stipulates to produce 2 certificates along with electronic evidences, one (Part A) which is to be signed by a person in charge of the computer or communication device or the management of the relevant activities (whichever is appropriate) and other (Part B) which is to be signed by an expert after validating the Hash values of the evidence device. Moreover, the schedule also stipulates to enclose a Hash report generated by the software/hardware used to authenticate the evidence device. Generation of hash values of a file may be a simple process. But generation of hash values of an evidence device like flash drive, hard disk etc is more complex and involves the usage of forensic software/hardware. Moreover to preserve the drive integrity or the Hash value of drive once generated, always the drive has to be connected through forensic write blockers for hash validation to issue Part B of the schedule. As a qualified expert under Section 39(1) of the Bharatiya Sakshya Adhiniyam (BSA) 2023, I am capable of issuing Part B of certificate under Section 63(4)(c) of the BSA 2023, after validating hash values in Part A and thus providing the expert certification necessary for electronic records in judicial proceedings.
